DEFERRED ACTION FOR CHILDHOOD ARRIVALS (DACA)

On June 15, 2012 it was announced that the Department of Homeland Security (DHS) would offer deferred action for two years to certain immigrants who came to the United States prior to their 16th birthday if certain other criteria was met.

This benefit also applies to immigrants in removal proceedings, with final orders of removal or voluntary departure orders. The DACA process was recently extended for an additional 2 years

According to the government, more than 500,000 individuals have received DACA. Applicants must meet the following criteria:

  1. Under 31 years of age on June 15, 2012;
  2. Came to U.S. before reaching 16th birthday;
  3. Has continuously resided in US since June 15, 2007, up to the present time;
  4. Must not have lawful status at time application is submitted;
  5. Currently in school or graduate of High school or completion of GED; and
  6. Has not been convicted of a felony, or a “significant misdemeanor,” three or more other misdemeanors, or does not otherwise pose a threat to national security or public safety.
