PRESIDENT OBAMA’S NOVEMBER 20, 2014 EXECUTIVE ACTION

Deferred Action for Parents (DAPA)

Requirements:

• Parents of U.S. citizen or lawful permanent resident child on November 20, 2014;
  
• Physically present in the U.S. since January 1, 2010;
  
• Physically present in the U.S. on November 20, 2014;
  
• Not in lawful status on November 20, 2014;
  
• Not convicted of a felony, significant misdemeanor, or multiple misdemeanor offenses;

Applications to be accepted in May of 2015

Expansion of Deferred Action for Childhood Arrivals (DACA)

Requirements

• Arrived in U.S. prior to 16th birthday;
  
• Physically present in the U.S. since January 01, 2010 to present;
  
• Physically present in the U.S. on November 20, 2014;
  
• Not in lawful status on November 20, 2014;
  
• Currently enrolled in school, graduated from high school, obtained GED, enrolled in GED classes or honorably discharged veteran of the Armed Forces.
  
• Not convicted of a felony, significant misdemeanor, or multiple misdemeanor offenses;
  
• At least 15 years old (may be younger if in removal proceedings)
  

Applications Accepted in February of 2015

Expansion of Provisional Waivers (Stateside Waivers)

• Originally applied only to spouses and children of U.S. citizens.
  
• Expanded to include spouses and children of lawful permanent residents and adult children.
