PRESIDENT OBAMA’S NOVEMBER 20, 2014 EXECUTIVE ACTION
Deferred Action for Parents (DAPA)
Requirements:
- Parents of U.S. citizen or lawful permanent resident child on November 20, 2014;
- Physically present in the U.S. since January 1, 2010;
- Physically present in the U.S. on November 20, 2014;
- Not in lawful status on November 20, 2014;
- Not convicted of a felony, significant misdemeanor, or multiple misdemeanor offenses;
Applications to be accepted in May of 2015
Expansion of Deferred Action for Childhood Arrivals (DACA)
Requirements
- Arrived in U.S. prior to 16th birthday;
- Physically present in the U.S. since January 01, 2010 to present;
- Physically present in the U.S. on November 20, 2014;
- Not in lawful status on November 20, 2014;
- Currently enrolled in school, graduated from high school, obtained GED, enrolled in GED classes or honorably discharged veteran of the Armed Forces.
- Not convicted of a felony, significant misdemeanor, or multiple misdemeanor offenses;
- At least 15 years old (may be younger if in removal proceedings)
Applications Accepted in February of 2015
Expansion of Provisional Waivers (Stateside Waivers)
- Originally applied only to spouses and children of U.S. citizens.
- Expanded to include spouses and children of lawful permanent residents and adult children.
